Terms of Service

Version 1.0 · Effective 18 September 2026 · These terms are a contract between you and GROW THROUGH PLAY SRL for the use of sprouzy.com and the Sprouzy apps.

1. Who we are

“Sprouzy”, “we”, “us” and “our” mean GROW THROUGH PLAY SRL. “You” means the adult who uses the service.

2. Accepting these terms

By opening the Sprouzy app, creating an account or using sprouzy.com you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. If you use Sprouzy on behalf of a school, nursery or other organisation, you confirm you are authorised to bind it, and “you” includes that organisation.

3. Who may use Sprouzy

• You must be at least 18 years old and the parent or legal guardian of any child whose profile you create, or have that parent's permission.
• Children use Sprouzy under your supervision and through your account. A child may not create an account.
• Sprouzy is designed for children aged approximately 3 to 10. Outside that range the tasks may be too easy or too hard; use your judgement.

4. What Sprouzy is

Sprouzy is a software service that, based on a short questionnaire completed by the parent, builds a daily plan of short exercises for a child — typically two attention or memory tasks played on screen and two physical activities done away from the screen — together with activity cards, bedtime tales and calming sounds. The plan adapts to the child's results. Sprouzy is available as a web app, as apps for phones and tablets, and as an app for Android TV, and lets you print a plan or a game on paper.

We may add, change or remove individual games, cards, tales, sounds or languages over time. The service is provided in the languages listed inside the app; we do not promise a language that is not yet in the app.

5. Your account

• You can try Sprouzy without an account. An account is needed only to use the same plan on more than one device.
• Give a real e-mail address you control; we use it to activate the account and to reach you about the service. Keep your password confidential. You are responsible for everything done through your account until you tell us it has been compromised.
• One account may hold profiles for several children of the same family. Please do not share your account outside your household.
• You can delete your account at any time from the app's settings or by e-mail. Deleting the account deletes the children's plans and progress; we cannot restore them afterwards.

6. Licence and intellectual property

Everything in Sprouzy — the software, the method of building the plan, the games, illustrations, activity cards, tales, sounds, texts, translations, the name Sprouzy and its logo — belongs to GROW THROUGH PLAY SRL or to licensors who allow us to use it, and is protected by copyright, trademark and other laws. Sprouzy™ is a trademark of GROW THROUGH PLAY SRL; registration is pending in the United Kingdom and may be sought elsewhere. Parts of the method may be the subject of a pending patent application.

We give you a personal, non-exclusive, non-transferable, revocable licence to use Sprouzy and to print its materials for use within your own family (or, for an organisation, with the children in its care) for as long as these terms are in force. You may not:

• copy, sell, rent, lend, sublicense or otherwise distribute the app, the printed materials or any content, or make them available to the public;
• use the content to make a competing product, course, book or app;
• reverse-engineer, decompile or extract the source code, data or content of the app, except where the law expressly allows it;
• remove or alter any copyright, trademark or other notice;
• use the name Sprouzy, the logo or the look of the app in a way that suggests we endorse you.

Feedback you send us may be used to improve the service without any obligation to you.

7. Acceptable use

You agree not to interfere with the service: no automated access, scraping, load testing, probing for vulnerabilities, bypassing access controls or limits, uploading malicious code, or using Sprouzy for anything unlawful. If you find a security problem, please tell us at contact@sprouzy.com before telling anyone else; we will not take action against good-faith reports.

8. Access, paid features and printed products

Access. We open Sprouzy to families in stages. Leaving your e-mail through “Get access” asks us to contact you when a place is available; it does not create an account or any obligation to pay.

Paid features. Some features may require payment, either as a one-off purchase or a subscription. Before you pay, the app or the website shows what you get, the price including VAT, the billing period and how to cancel. Purchases made through Google Play or the App Store are governed also by the store's terms, are billed by the store, and are cancelled and refunded through the store. A subscription renews automatically at the end of each period unless you cancel before it renews; cancelling stops the next renewal and keeps access until the end of the paid period. We may change prices for future periods with at least 30 days' notice; you can cancel before the change applies.

Printed products. If we sell printed plans, cards or books, an order is accepted when we confirm it by e-mail. We tell you the price, delivery cost and estimated delivery time before you order. Printed items made to your child's individual plan are personalised goods. Ownership passes on delivery; risk of loss passes when the goods are handed to you.

All prices are shown in the currency stated at checkout and include VAT where applicable. We issue an invoice for every purchase to the e-mail on the order.

9. Right of withdrawal and refunds (consumers in the EU and UK)

• Digital content and subscriptions bought directly from us: you have 14 days from the purchase to withdraw without giving a reason, unless you asked us to start providing the content immediately and acknowledged that you thereby lose the right of withdrawal — the app asks for exactly that acknowledgement at the moment of purchase. Even then, if the service turns out not to work as described, you keep your statutory remedies (repair, replacement, price reduction or refund).
• Physical, non-personalised goods: 14 days from delivery to withdraw; return the goods within 14 days of telling us, in the condition received; we refund the price and standard delivery within 14 days of receiving the goods back. Return postage is at your cost unless the item was faulty.
• Personalised goods (a printed plan made for your child) are exempt from the right of withdrawal under Article 16(c) of Directive 2011/83/EU, but you are still entitled to a replacement or refund if they are faulty or not as described.
• To withdraw, e-mail contact@sprouzy.com with your order number, or use the model withdrawal form in Annex I(B) of Directive 2011/83/EU.
• Purchases made through an app store are refunded under that store's policy; contact the store first.

Nothing here limits the two-year legal guarantee of conformity for consumers in the EU (Directive (EU) 2019/770 and 2019/771) or your rights under the UK Consumer Rights Act 2015.

10. Not medical, psychological or educational advice

Sprouzy offers play-based activities that many families find helpful for building attention, patience and coordination. It is not a diagnostic tool, a therapy, a medical device or a substitute for the advice of a doctor, psychologist, therapist or teacher. The starting questionnaire and the levels the app assigns are not an assessment of a child's development or ability, and nothing in the app should be read as one. If you have concerns about your child's development, attention or health, speak to a qualified professional.

Physical activities are simple bodyweight movements meant for a normal living space. You decide whether an activity is suitable for your child, supervise it, and stop if the child is tired, unwell or the space is unsafe. You are responsible for the child's physical safety during any activity.

11. Our liability

We provide Sprouzy with reasonable skill and care. To the extent the law allows:

• We are not liable for loss or damage that was not foreseeable when you agreed to these terms, that was caused by your breach of them, or that results from events outside our reasonable control.
• We are not liable for indirect or consequential loss, loss of data you did not back up (progress in “try it” mode lives only on your device), or business losses — Sprouzy is for personal, family use.
• For paid features, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything that cannot be excluded under the law of the country where you live. Your statutory consumer rights are not affected.

12. Availability and changes

We aim to keep Sprouzy available at all times but do not guarantee uninterrupted service; we may pause it for maintenance, security or updates, and will try to do so at quiet times. We may update the app and its content, and may require you to install an update to keep using it. We may change these terms; if a change materially reduces your rights we will tell account holders at least 30 days in advance by e-mail or in the app, and you may end the agreement before the change applies. Continued use after that date is acceptance of the new terms.

13. Ending the agreement

You may stop using Sprouzy and delete your account at any time. We may suspend or close an account, after notice where practicable, if you seriously or repeatedly breach these terms, if we are required to by law, or if we discontinue the service — in the last case with at least 60 days' notice and a pro-rata refund of any prepaid period. Sections 6, 10, 11, 15 and 16 survive the end of the agreement.

14. Privacy

How we handle personal data — including that you can use the app without giving us any, and that the child's data stays on your device unless you choose to create an account — is set out in our Privacy Policy, which forms part of these terms.

15. Governing law and disputes

These terms are governed by the law of Romania. If you are a consumer living in another EU/EEA country or in the United Kingdom, you also keep the protection of the mandatory consumer laws of your country, and you may bring a claim in the courts of that country. Otherwise the courts of Romania have jurisdiction.

If you have a complaint, write to us first at contact@sprouzy.com — most things can be sorted out quickly. Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, and in Romania may turn to the National Authority for Consumer Protection (ANPC, anpc.ro) or the SAL/ADR consumer mediation service. We are not obliged to take part in alternative dispute resolution proceedings but will consider doing so.

16. Other provisions

• These terms, the Privacy Policy and the information shown at the point of any purchase are the whole agreement between us about Sprouzy.
• If any part of these terms is held invalid, the rest remains in force.
• We may transfer our rights and obligations under these terms to a company that takes over the Sprouzy service, with notice to you; your rights are not reduced by that.
• Our not enforcing a provision is not a waiver of it.
• These terms are written in English. Where we publish translations, the English version prevails if they differ, except where the law of your country requires otherwise.
